Terms of Service

Welcome to Rekindle. These Terms of Service ("Terms") govern your use of the Rekindle mobile application ("App") operated by Rekindle ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 17 years old to use Rekindle. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

2. Account Registration

To use Rekindle, you must create an account using Apple Sign In or Google Sign In. You are responsible for maintaining the security of your account and for all activities that occur under it. You agree to provide accurate, current, and complete information.

3. Partner Linking

Rekindle is designed for use between two consenting adults in a relationship. By sharing your invite code with another person, you consent to sharing your daily question answers with that person (after both partners have answered). You may unlink from a partner at any time through the App's settings.

4. Subscription and Payments

4.1 Subscription Plans

Rekindle offers monthly ($4.99/month) and yearly ($34.99/year) subscription plans. One subscription covers both you and your linked partner — the joining partner does not need a separate subscription.

4.2 Billing

Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

4.3 Cancellation

You may cancel your subscription at any time through your Apple ID settings (Settings → Apple ID → Subscriptions → Rekindle). Upon cancellation, your subscription remains active until the end of the current billing period. No refunds are provided for partial periods.

4.4 Free Trial

If a free trial is offered, it will be clearly stated at the time of subscription. Any unused portion of a free trial is forfeited when you purchase a subscription.

4.5 Price Changes

We reserve the right to adjust pricing. Any price changes will take effect at the start of the next subscription period after notice. Continued use after a price change constitutes acceptance.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Submit content that is abusive, threatening, harassing, defamatory, obscene, or otherwise objectionable
  • Attempt to access another user's account or data without authorization
  • Interfere with or disrupt the App's infrastructure or security
  • Reverse-engineer, decompile, or disassemble any part of the App
  • Use automated scripts, bots, or scrapers to access the App
  • Resell, redistribute, or sublicense the App or its content

6. User Content

6.1 Your Answers

You retain ownership of the answers and custom questions you submit through the App. By submitting content, you grant us a limited license to store and transmit it (in encrypted form) solely for the purpose of operating the App.

6.2 Content Standards

While your answers are encrypted and private between you and your partner, you agree not to use the custom question feature to send content that violates these Terms or applicable law.

7. Intellectual Property

The App, including its design, code, question library, graphics, and branding, is owned by Rekindle and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect, use, and protect your data.

9. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Rekindle is not a substitute for professional relationship counseling, therapy, or mental health services. The questions and features are designed for general relationship enrichment and are not clinical tools.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REKINDLE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Rekindle and its affiliates from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the App at any time for any reason, including violation of these Terms. You may terminate your account at any time by deleting it through the App's settings. Upon termination, your right to use the App ceases immediately, and we will delete your data in accordance with our Privacy Policy.

13. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

15. Apple-Specific Terms

If you access the App through the Apple App Store, the following additional terms apply:

  • These Terms are between you and Rekindle, not Apple. Apple has no obligation to provide maintenance or support for the App.
  • Apple is not responsible for any claims relating to the App, including product liability claims, consumer protection claims, or intellectual property infringement claims.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
  • You must comply with any applicable third-party terms of agreement when using the App.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or by email at least 30 days before taking effect. Your continued use of the App after changes become effective constitutes acceptance.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Rekindle regarding your use of the App and supersede all prior agreements.
